Terms of Service

1. Acceptance of Terms By installing, activating, or using the PictaBase plugin (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
2. Service Description PictaBase is a self-hosted WordPress plugin that provides visual database management (Digital Asset Management) capabilities. The Service indexes and organizes image metadata while your actual image files are stored in your own Amazon S3 bucket.
3. Licensing & Entitlements PictaBase offers a Lifetime Deal (LTD) license distributed through AppSumo. Each license code entitles the holder to a specific tier of service. Up to four codes may be stacked to unlock higher tiers.
- Licenses are non-transferable and tied to the redeeming WordPress user account.
- Lifetime Deal entitlements apply to the current version of the Service and all future updates.
- “Lifetime” refers to the lifetime of the product, not the purchaser.
4. Supported File Types The Lifetime Deal license is strictly limited to static image files (JPEG, PNG, WEBP, TIFF, HEIC, RAW). Video files, audio files, and other large binaries are not supported under the Lifetime Deal storage allowance. Attempts to bypass file type restrictions may result in account suspension.
5. Storage & Top-Ups Each tier includes a base storage allowance. Additional storage may be purchased as recurring top-up subscriptions ($5/month per 100 GB). Top-up storage is additive to the base tier allowance and is never affected by tier upgrades.
Storage is measured by the total file size of assets indexed in PictaBase, charged to the project owner (not individual uploaders).
6. Fair Use of Unlimited Seats The “Unlimited Seats” entitlement (Tier 4) is intended for the internal collaboration of a single creative entity (agency, studio, or production team).
Prohibited Uses:
- Reselling individual seats to third parties.
- Using a single Project to host assets for unrelated third-party organizations (i.e., acting as a “DAM Service Provider”).
- Automated account creation or “bot” activity.
PictaBase reserves the right to throttle API access or terminate accounts that exhibit usage patterns inconsistent with human collaboration (e.g., exceeding 10,000 API calls per hour per seat).
7. Your Data & Responsibility You are solely responsible for the content you upload and organize using PictaBase. You retain full ownership of your images and metadata. PictaBase does not claim any intellectual property rights over your content.
Because PictaBase uses a “Conductor” architecture, your image files are stored in your own S3 bucket. You are responsible for your AWS account security, billing, and compliance with AWS terms.
8. Service Availability PictaBase is a self-hosted plugin. Service availability depends on your WordPress hosting environment. We do not guarantee uptime, but we commit to providing timely bug fixes and security updates.
9. Termination We may suspend or terminate access to the Service for violations of these Terms, including but not limited to: abuse of unlimited seat entitlements, circumvention of file type restrictions, or failure to maintain a valid license.
Upon termination, your images remain in your S3 bucket. Metadata sidecar files (.meta.json) ensure data portability independent of PictaBase.
10. Limitation of Liability PictaBase is provided “as is” without warranty of any kind. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Service, including but not limited to data loss, business interruption, or loss of profits.
11. Changes to Terms We may update these Terms from time to time. Material changes will be communicated through the plugin’s admin interface. Continued use of the Service after changes constitutes acceptance of the revised Terms.
